Parties
This agreement is made in Columbus, Ohio, between Cozy Corners LLC (the PROPERTY MANAGER) and the guest named on the reservation who accepts it online (the GUEST). The PROPERTY MANAGER provides the GUEST the property and stay dates on the GUEST's reservation, in exchange for the fees paid and the GUEST's agreement to the following terms.
1. Card Authorization
By putting a card on file at cozycornersllc.com, the GUEST authorizes the PROPERTY MANAGER to store that card securely with its payment processor, Authorize.net, and to use it without a further signature to: (a) place the damage deposit authorization described in Section 3; and (b) charge amounts the GUEST owes under this agreement, including damages, extra cleaning, and the fees listed in this agreement and the Check-Out Charges.
Nothing is charged when the card is saved. To confirm the card is valid, the card issuer may show a $0 or $0.01 authorization that is voided immediately.
Before charging anything other than the deposit hold, the PROPERTY MANAGER will email the GUEST an itemized notice of the amount and the reason. This authorization lasts until all amounts owed under this agreement are settled. The GUEST may revoke it for future charges by emailing cozycorners2023@gmail.com; revoking does not cancel amounts already owed. Charges will appear on the GUEST's statement as Cozy Corners LLC.
2. Payments
Reservation charges (nightly rate, cleaning fee, and taxes) are paid in full through the booking platform before check-in, and that platform's cancellation terms apply. Deposit holds and any later charges under this agreement are made to the card the GUEST put on file under Section 1.
3. Damage Deposit (Card Hold)
A $500 authorization may be placed on the card on file starting 24 hours before check-in. This is a hold, not a charge. If damage, extra-cleaning, or violation fees exceed $500, the GUEST authorizes the PROPERTY MANAGER to charge the same card for the balance. Itemized notice will be issued within 72 hours of checkout, before any charge is made. If no claim is made, the PROPERTY MANAGER will release the hold; depending on the card issuer, it can take up to 30 days to disappear from the GUEST's statement. Disputed amounts will follow the booking platform's resolution process, where one applies, before any legal action.
4. Behavior
The property will not be used for any unlawful purpose, nor for any purpose deemed hazardous by the PROPERTY MANAGER or by the PROPERTY MANAGER's insurance company. Violation of this provision is grounds for immediate removal from the property, and the PROPERTY MANAGER reserves the right to remove any guest for illegal activities in connection with controlled substances.
The GUEST will obey all laws, ordinances, rules, and regulations of all governmental agencies having jurisdiction over the property, including any homeowners' or condominium association bylaws and rules, and is responsible for any fees resulting from noncompliance. The GUEST will not be noisy or boisterous, or act in any manner offensive to neighboring properties or that disturbs the quiet enjoyment of any other guest or occupant of the neighboring properties.
The GUEST and the GUEST's guests, invitees, occupants, and anyone under the GUEST's control shall not interfere with management of the property. Interference includes, but is not limited to, circumventing the PROPERTY MANAGER to contact the property owner directly for any reason; hostility, screaming, threatening, foul or demeaning language; abusive or inappropriate conduct; and acts of aggression toward the PROPERTY MANAGER or the PROPERTY MANAGER's employees, contractors, or agents, in any verbal, written, or digital communication. Each violation carries a $50 fee charged to the card on file.
If the GUEST breaches this agreement after receiving one (1) or more notices to remedy a violation, the PROPERTY MANAGER may terminate this agreement and remove the GUEST.
5. Trash
The GUEST shall dispose of all rubbish, garbage, and other waste in a clean, safe, and sanitary manner. The trash and recycling schedule is available from the City of Columbus.
6. Noise Levels and Sensor Devices
The GUEST must keep reasonable sound levels at all times and honor quiet hours from 10 pm to 7 am. Sentry™ noise sensors may be installed. A reading of 75 dB or more for 10 or more minutes is a violation. Fees for violations: 1st violation, a written warning; 2nd violation, a $250 noise fee; 3rd violation, a $500 fee, and any further breach is material non-compliance and grounds for removal. Tampering with a sensor (unplugging, removing, or covering it) is $500 per incident.
7. Alarms
The GUEST shall pay all false security alarm fees, and shall promptly notify the PROPERTY MANAGER if an alarm goes off.
8. Maintenance
The GUEST is responsible for: repairing stopped-up toilets, drains, sinks, floor drains, and garbage disposals; all glass breakage, screen damage, and drain clogs resulting from neglect or misuse; and all costs the PROPERTY MANAGER incurs for work at the property that is found to be the GUEST's responsibility, which may include a markup fee.
If the GUEST requests emergency maintenance, the GUEST agrees to be available by phone after the request and to be present at the property until it is resolved.
The GUEST agrees that the PROPERTY MANAGER and its authorized representatives may photograph the premises during routine inspections, maintenance visits, check-in, and check-out. These photographs are used only to document property condition, verify compliance with this agreement, and keep accurate records.
9. Basements (Where Applicable)
Basements may flood at any time; the GUEST shall keep personal belongings elevated off the basement floor. Basements may have high humidity; the GUEST is responsible for keeping the provided dehumidifier running at all times. Damage caused by high humidity is the GUEST's responsibility.
10. Damage and Alterations
The GUEST is responsible for any damage to persons, property, furniture, or carpeting caused by the GUEST or the GUEST's guests, agents, or invitees, regardless of fault.
The GUEST shall not install equipment or waterbeds, or make alterations, additions, or improvements to the property without the PROPERTY MANAGER's written consent. No repairs will be made or credited without the PROPERTY MANAGER's written approval. The GUEST is responsible for damage from wind, snow, or rain caused by leaving windows open.
11. Cleanliness and Care
The GUEST shall: keep the interior and exterior of the property clean and in good condition, and keep plumbing fixtures and appliances as clean as their condition permits; protect pipes from freezing; repair any damage caused by misuse or neglect; return the property at checkout in as good condition as at check-in, reasonable wear and tear excepted; and limit cooking smells reaching neighboring units by using windows and exhaust fans or by avoiding strong cooking odors.
12. Appliances and Equipment
All furniture and appliances provided for the GUEST's use belong to the PROPERTY MANAGER, including but not limited to the range, refrigerator, dishwasher, washer and dryer, garage openers, mailbox keys, trash and recycling bins, ceiling fans, dehumidifiers, couches, chairs, tables, shower curtains, lamps, and desks. Any item shown in the pre-stay photos of the property but missing at checkout will be replaced at the GUEST's expense.
13. Moisture and Property Observation
The GUEST shall watch for water leaks, moisture problems, wildlife intrusion, and mold, and shall notify the PROPERTY MANAGER immediately of any need for repairs. If the property is damaged because the GUEST failed to notify the PROPERTY MANAGER, the GUEST will pay the cost of repairs within 30 days of the PROPERTY MANAGER's demand. The GUEST agrees to ventilate and control moisture (especially in kitchens, bathrooms, and around exterior walls) to prevent mold, and to notify the PROPERTY MANAGER immediately of any mold, mildew, or moisture condition. The GUEST releases the PROPERTY MANAGER from liability for bodily injury or property damage caused by or associated with moisture, mold, or mildew at the property.
14. Subletting
The property may be occupied only by people who have a written agreement with the PROPERTY MANAGER. The GUEST shall not list the property on any short-term rental platform, or assign, sublet, or license occupancy to anyone, without the PROPERTY MANAGER's prior written approval, which may be withheld for any reason.
First violation: an administrative fee of $500 plus $200 per unauthorized night (roughly the premium short-term rental rate in Columbus). Second violation, or continued listing after notice: the fee above plus the greater of $3,000 or twice the gross nightly revenue earned, treated as liquidated damages, and a material breach that is grounds for removal. The GUEST agrees these amounts are a reasonable estimate of advertising harm, increased wear, and potential municipal fines, which are difficult to calculate precisely.
15. Smoking
No smoking, vaping, burning, or inhaling of any substance (including tobacco, marijuana, electronic cigarettes, hookah, incense, or similar products) is permitted anywhere inside the dwelling, on balconies, stairwells, or hallways, or within fifteen (15) feet of any door, window, or ventilation opening.
The GUEST consents to the property being equipped with Sentry™ air-quality and noise monitoring devices, and to post-checkout inspections. A smoking or vaping violation may be established, in the sole and reasonable discretion of the PROPERTY MANAGER, by any one or more of: sensor alerts or abnormal air-quality readings; odors detected by management, cleaners, inspectors, or contractors; visible residue, ash, burn marks, filters, paraphernalia, or waste; guest admissions, messages, or third-party complaints; or post-checkout inspection findings. Such evidence is reasonable proof of a violation.
Fees per event: $500 for the first verified smoking or vaping event; $750 for the second; $1,000 for the third, plus termination at the PROPERTY MANAGER's option; and a $500 flat fee for tampering with, unplugging, covering, or disabling a Sentry™ device. Additional damages such as odor remediation and repainting remain recoverable under Section 19.
16. Property Restrictions
The property is for residential use only. No business activity or storage of business equipment or supplies is allowed, and business vehicles and trailers may not be parked at or around the property. The GUEST shall not install anything that damages the wall surface or plaster when removed; paint without the PROPERTY MANAGER's prior approval; keep a water-filled aquarium larger than 3 gallons; use any fireplace (all are decorative only); or install a satellite dish.
17. Unauthorized Occupants
No one other than the registered guests may occupy the property without the PROPERTY MANAGER's prior written approval. If any unregistered overnight guest is at the property, the PROPERTY MANAGER may immediately terminate this agreement and remove the GUEST.
18. Pets
The GUEST may bring one or more pets registered with the PROPERTY MANAGER, for a pet fee of $50 per pet per stay. Unregistered pets are not permitted on the property for any length of time, even a short visit. Pet waste must be promptly bagged and properly disposed of; failing to do so incurs an agreement violation fee for each occurrence. Dogs must be leashed at all times unless indoors or in a fenced backyard. No exterior tethering or housing of pets is allowed. Pets must be supervised at all times when outside the home and secured during any maintenance or management walkthrough.
No exotic pets are permitted. Fees: $50 per unregistered or visiting animal, plus actual veterinary or cleanup costs for fleas, waste, or property damage.
19. Fees and Damages
The GUEST agrees to pay: $50 per missed appointment, plus all charges caused by the missed maintenance or staff appointment; $500 per incident for any guest, invitee, or occupant entering any part of the building or property outside the reserved unit and designated common areas without the PROPERTY MANAGER's prior written consent; $200 for each overnight occupant not registered on the reservation at check-in; $50 for impeding the PROPERTY MANAGER's reasonable attempts to access the property; and $250 for the time required to assess and quantify excessive check-out damages.
Damages: actions taken or not taken by the GUEST may cause financial harm to the PROPERTY MANAGER. The GUEST agrees to pay any and all damages resulting from the GUEST's actions or negligence.
20. Deposit Release and Inspection
The $500 card hold will be fully released if the property is returned in comparable condition. If deductions are required, the GUEST will receive an itemized statement, the hold will be captured up to the amount of the claim, and any amount above $500 will be charged to the card on file.
If the GUEST does not comply with this agreement, the PROPERTY MANAGER may keep all or part of the deposit as partial liquidated damages, without giving up its right to recover any further damages it is entitled to.
The PROPERTY MANAGER is not responsible for mail, packages, deliveries, or other items delivered or misdelivered to the property, and will not forward, hold, deliver, or return them. The GUEST is responsible for their own mail forwarding.
The PROPERTY MANAGER will inspect the property promptly after the GUEST's scheduled checkout and assess any damage beyond normal wear and tear. Potential charges are listed in the Check-Out Checklist and Charges below. The GUEST may avoid these charges by having the needed repairs completed before checkout.
21. Early Departure
No refund will be made for leaving before the end of the stay.
22. Exterior Security Cameras
Exterior cameras are installed only to deter crime and document exterior activity; they do not guarantee safety. Guests and occupants shall not disable, unplug, cover, redirect, damage, or otherwise tamper with any camera or its wiring. Each act of tampering is a material breach of this agreement, carrying liquidated damages of $500 per incident plus the full cost of repair or replacement, and is grounds for termination of the stay. Cameras cover only exterior and common areas and never record the inside of any dwelling unit.
23. As-Is Condition
The GUEST accepts the property as is, except for conditions that materially affect the health or safety of ordinary persons. The PROPERTY MANAGER makes no implied warranties. The GUEST shall report all defects or damage within four (4) hours of check-in; otherwise, the property is presumed to be clean, safe, and in good working condition.
24. Locks, Keys, and Entry
The GUEST shall not install, replace, or re-key any lock without the PROPERTY MANAGER's prior written consent. If a lock is changed or disabled, or any key is not returned within 24 hours of written demand, the GUEST owes liquidated damages of $150 per incident plus all actual locksmith costs (labor, materials, and mileage). Unauthorized key duplication is a separate violation at $50 per key.
The GUEST shall not unreasonably withhold consent for the PROPERTY MANAGER or its agents to enter the property. The PROPERTY MANAGER may enter by other means if locks have been changed in violation of this agreement.
Replacement or extra keys and fobs are provided at the GUEST's request, or if one is lost, at the GUEST's cost: actual cutting cost up to $15 per mechanical key, and actual device cost up to $50 per electronic fob or smart key. All keys and fobs remain the PROPERTY MANAGER's property and must be returned at checkout; any not returned are billed at the same rates.
25. Security
Security measures provided by the PROPERTY MANAGER are not a guarantee against crime or a reduction in the risk of crime. The GUEST may be held responsible for costs the PROPERTY MANAGER incurs to repair break-in damage and to secure the property during the stay.
26. Overstay
If the GUEST does not return the keys or stays past checkout time without an extension or permission, the GUEST will be charged the prorated nightly rate, plus the booking platform's override fee and $250 per night, plus any consequential costs. The PROPERTY MANAGER may also sue for damages caused by the late checkout.
27. Liability
The PROPERTY MANAGER is not liable to the GUEST, the GUEST's guests, or occupants for: injury, damage, or loss caused by the criminal conduct of others, including theft, burglary, assault, or vandalism; personal injury or loss of personal property from fire, flood, water leaks, basement flooding, rain, hail, ice, snow, smoke, lightning, wind, or explosions; or interruption of utilities, unless caused by the PROPERTY MANAGER's negligence.
28. Default by Guest
If the GUEST defaults on, violates, or fails to comply with any term of this agreement or any policy the PROPERTY MANAGER adopts, the PROPERTY MANAGER may terminate this agreement and remove the GUEST.
29. Entry Notice
The PROPERTY MANAGER or its agents may enter and inspect the property in an emergency or when a violation of this agreement is suspected. Otherwise, the PROPERTY MANAGER will give the GUEST at least 24 hours' notice before entering, which may be given by email or text.
30. Possession
If the GUEST performs all of the terms of this agreement, the GUEST is entitled to possession of the property during the stay. The PROPERTY MANAGER's failure to enforce its rights on any default does not waive its rights on any later default.
31. Governing Law
Accepting this agreement is a transaction of business in Ohio within the meaning of Ohio Civil Rule 4.3(A)(1) and Ohio Revised Code Section 2307.382. Ohio law governs the interpretation of this agreement.
32. Attorney Fees
In any action arising out of this agreement, the prevailing party, whether the PROPERTY MANAGER or the GUEST, may recover its reasonable attorney fees and court costs actually incurred, to the extent Ohio law permits and the court finds reasonable.
33. Entire Agreement
This agreement is the entire agreement between the PROPERTY MANAGER and the GUEST. No oral or written representations not contained in it bind either party. The PROPERTY MANAGER's representatives have no authority to waive, amend, or terminate this agreement, or to make promises that impose security or other obligations on the PROPERTY MANAGER, unless done in writing. No action or inaction by a representative waives any later violation.
34. Severability
If any part of this agreement is found void, unenforceable, or against public policy, the rest of the agreement is not affected.
35. Binding Effect
This agreement binds the PROPERTY MANAGER and the GUEST and their respective heirs, successors, executors, and administrators.
Check-Out Checklist
This checklist and the charge list below help us inspect quickly and release the $500 card hold. If charges exceed the hold, the card on file will be charged the difference under Section 3. The PROPERTY MANAGER inspects after checkout, expects the property in the same condition as at check-in, and makes the final determination of what is normal wear and tear and what is damage, abuse, or neglect.
Before leaving, please make sure: all fees are paid or a written settlement is agreed; the whole property is clean and all trash is removed; any nail or other holes you made are repaired; outside hoses are disconnected and stored; window wells are clear of trash, weeds, and debris; the thermostat is left on (78° in summer, 62° in fall and winter); blinds are fastened, hung properly, and clean (broken window coverings are replaced at your expense); the refrigerator, stove, oven, and microwave are clean and left plugged in and running; all personal property and vehicles are removed (anything left behind is treated as abandoned and disposed of at your expense); windows, window tracks, and door windows are clean; and all doors and windows are locked, with all keys and garage remotes returned (missing remotes are charged, plus the cost to reprogram the opener).
